This morning, Barrister Sly Ezeokenwa secured another significant victory against Edozie Njoku. The Appeal Court Abuja Division granted Ezeokenwa and others the right to appeal its earlier judgment to the Supreme Court. It is essential to emphasize that this decision pertains to a procedural leave to appeal, not a stay of execution.

Contrary to recent claims by Edozie Njoku and his co-travelers, the Appeal Court never instructed INEC to recognize Chief Edozie Njoku as the National Chairman of APGA in its ruling of June 28, 2024. The confusion stems from the fact that APGA and its current National Chairman, Barrister Ezeokenwa, were not parties to the original suit filed at the FCT High Court, which only addressed Victor Ike Oye, the former APGA Chairman.

Edozie Njoku had opposed the granting of leave to appeal, aiming to prevent Ezeokenwa from challenging the Appeal Court’s judgment, which had misinterpreted the Supreme Court’s ruling by implying that Njoku was the National Chairman referenced in that judgment. Barrister Sly Ezeokenwa and APGA could not have applied for a stay of execution since they were not initially joined in the suit. Only those who were initially joined could apply for a stay of execution regarding the misinterpretation of the Supreme Court judgment.

Recall that the Supreme Court had earlier clarified in its response to its judgment—obtained by APGA in August 2024 and by Edozie Njoku many months prior, but concealed because it did not favor him, misleading the FCT High Court—that it never ordered INEC to recognize Edozie Njoku as APGA’s National Chairman. This clarification was corroborated months earlier by documents obtained by Njoku himself, which also confirmed that INEC Chairman Mahmood Yakubu did not disobey any court order by not recognizing Njoku.

Given these clarifications, the win for APGA and Barrister Ezeokenwa led NWC is almost certain and comprehensive. The Supreme Court is expected to reaffirm this position, further solidifying the resolution of this leadership dispute.
