The Department of State Services (DSS) has filed a defamation lawsuit worth N5.5 billion against the Socio-Economic Rights and Accountability Project (SERAP).
The suit stems from an allegation that it says SERAP claimed that the DSS invaded its Abuja office. The case was filed before the High Court of the Federal Capital Territory (FCT).
According to the DSS, the false claim harmed its corporate reputation, as well as the reputations of two of its officials, Sarah John and Gabriel Ogunleye, who are also part of the lawsuit. SERAP and its Deputy Director, Kolawole Oluwadare, were named as defendants in the case.
The DSS explained that the visit to SERAP’s office was a routine, friendly engagement aimed at building relationships with non-governmental organizations in Abuja. They stated that John and Ogunleye visited SERAP’s office on September 9, 2024, met with a staff member named Ruth, and discussed scheduling a formal meeting. According to the DSS, there was no conflict during the visit, and all interactions were recorded.
However, after the visit, SERAP posted on social media, claiming that DSS officers were unlawfully occupying its office. SERAP also published statements on its website, alleging that DSS officials had invaded the office and harassed staff. The group further called on President Bola Ahmed Tinubu to stop the DSS from intimidating SERAP’s directors.
The DSS argued that SERAP’s public accusations led to widespread criticism from organizations like Amnesty International and prominent figures such as Femi Falana. The agency said the allegations made it appear as though its officers were unprofessional and lawless, damaging their reputations and resulting in disciplinary actions.
The DSS is seeking a public apology from SERAP on its website, social media platforms, and in major Nigerian newspapers and television channels. Additionally, the agency is demanding N5 billion in damages and N50 million to cover legal costs.
The case has been assigned to Justice Yusuf Halilu for hearing.
